THUKRAL AND CO PTY LTD – TERMS AND CONDITIONS OF ENROLMENT
1. Corporate Ownership & Intellectual Property Protection
- Corporate Entity: All educational programs, services, and associated brands are owned and operated by Thukral and Co Pty Ltd (ABN: 29 639 496 629).
- Brand Protection: Sypher Space™ and its associated visual branding identify our proprietary educational, STEAM, robotics, and academic enrichment services.
- Business Name Portfolio: All custom curriculum, lesson structures, digital assets, operational systems, educational frameworks, and training materials delivered under Sypher Space™, Leaders & Speakers, KRE8ive Kindies, Robo Explorers, STEPPING STONEZ, and Learn & Enlighten remain the intellectual property of Thukral and Co Pty Ltd.
- Legacy & Future Branches: All intellectual property and historical trading rights are similarly reserved for the company's held and founding business names, including STEMnetic (established 2020) and Fine Shots.
- Restrictions: Unauthorised reproduction, commercial copying, distribution, adaptation, imitation, or rebranding of company intellectual property, teaching systems, operational frameworks, or educational content is strictly prohibited under Australian copyright and trademark laws.
2. Booking, Payments & Enrolment
- Payment Requirement: Payments for each term or program must be made in full prior to commencement unless otherwise approved by management.
- Mid-Term Starts: Students joining after commencement may be charged on a pro-rata basis.
- Admin Fees: Refund requests prior to commencement may incur a $20 administration fee.
- Operational Shifts: Thukral and Co Pty Ltd reserves the right to modify schedules, class structures, venues, instructors, lesson formats, pricing, or delivery arrangements where operationally required.
- Profile Updates: Parents/carers must notify Sypher Space™ within 2 business days regarding changes to emergency contacts, guardianship arrangements, or medical information.
3. Equipment & Technology Policy
- Device Allocation: Students may use robotics kits, laptops, tablets, and educational resources provided by Sypher Space™ during sessions.
- Device Restrictions: Students are not permitted to bring or use personal tablets, laptops, mobile devices, or external LEGO® pieces during class unless requested by the instructor for specific activities.
- Collaborative Learning & Liability: To foster teamwork and engineering collaboration, students typically work in pairs, sharing one robotics kit per two students. At the conclusion of each class, both students in the group are responsible for neatly packing and returning their assigned kit fully intact to the instructor.
- Shared Kit Liability (No Blame Clause): Because kits are shared, if a kit is returned damaged, incomplete, or with missing essential components at the end of a session, the replacement cost will be split equally (50/50) between the parents/carers of both students assigned to that kit, unless clear visual evidence or instructor observation definitively isolates the fault to a single student.
- Damage Fees: Damaged or lost LEGO®/robotics kits will be invoiced under these terms at a flat replacement fee of $675 inc. GST per kit (split at $337.50 inc. GST per family if divided equally). Damage to individual laptops, tablets, or screens will be charged at the exact cost of professional repair or replacement to the specific student responsible.
4. Cancellation & Absenteeism Policy
- No Post-Commencement Refunds: Once a term or workshop program has commenced, no refunds, partial refunds, or credits will be issued for voluntary withdrawals or change of mind.
- Student Absence: We do not offer make-up sessions, credits, or discounts for individual classes missed due to personal holidays, school events, routine illnesses, or scheduling conflicts. This policy allows us to maintain strict venue caps, staff ratios, and class continuity.
- Provider Cancellations: If a session is cancelled by the provider due to staff illness, venue unavailability, or extreme weather conditions, a make-up class, account credit, or pro-rata refund will be issued.
5. Attendance, Pick-Up & Drop-Off Policy
- Supervision Threshold: Thukral and Co Pty Ltd staff provide supervision strictly during the designated, active lesson hours. Parents/carers are responsible for the safety and supervision of children outside these hours.
- Drop-off and Pick-up: Children must be dropped off no earlier than 5 minutes before class and collected promptly at the session ending time.
- Late Pick-up Fees: Overtime pick-ups create critical staffing and venue issues. Late pick-ups will be automatically charged at a rate of $5.00 for the first 5 minutes, and $10.00 for every 1 minute thereafter.
- Repeated Lateness: Continued, repeated late collections demonstrate a breach of policy and may result in the permanent cancellation of the student's enrolment with zero refund.
6. Behaviour & Sessions Code of Conduct
- Zero Tolerance: To maintain a cooperative learning space, physical altercations, bullying, intentional equipment destruction, verbal abuse, or persistent disruption will not be tolerated
- Suspension and Removal: We reserve the right to suspend or permanently remove any student whose behavior poses a safety risk to themselves, staff, or peers. If a student is removed under this code of conduct, enrolment is terminated immediately without a refund.
7. Service NSW Creative Kids & Active Kids Vouchers
- Upfront Use Only: If you are using a Service NSW Creative Kids or Active Kids voucher, it must be submitted and validated online at the exact time of booking via the designated system fields.
- No Retroactive Application: If an enrolment booking is completed and fully paid without entering voucher details, the voucher cannot be applied retroactively to that transaction, and no cash refunds or account credits can be generated.
- Non-Redeemable: Under Service NSW guidelines, these government-issued educational vouchers are non-refundable and can never be exchanged, split, or redeemed for cash.
8. Medical & Emergency Policy
- Health Disclosure: Parents/carers warrant that their child is physically and medically fit to participate in activities and has disclosed all necessary care plans.
- Emergency Authorization: In the event of a medical emergency or accident involving your child, you authorize company staff to obtain necessary medical or ambulance assistance. You agree to cover all out-of-pocket medical or transport costs incurred.
- Liability Release: To the maximum extent permitted by Australian consumer law, parents/carers release and discharge Thukral and Co Pty Ltd, its directors, and staff from any claims, loss, or liability relating to personal injury sustained during our programs.
9. Media Content & Photography Consent
- Documentation Focus: Staff may take photographs or short video clips during sessions focusing on student projects, robot builds, coding achievements, or active learning.
- Privacy Options: Parents select a specific privacy level (Full Public, Internal Groups Only, or Strict No Photo) during the initial onboarding enrolment process.
- Data Security: All media assets are stored securely on company cloud architectures and can be reviewed or altered at any time by contacting admin@sypherspace.com.au.

- Trademark Independence: LEGO®, SPIKE®, DUPLO®, MINDSTORMS®, SCRATCH®, and PYTHON® are trademarks of their respective company networks.
- Thukral and Co Pty Ltd is an independent service provider and is not sponsored, endorsed, or officially affiliated with the LEGO Group or other tech platform networks.
